Vending in California K-12 schools is regulated twice over: the federal USDA Smart Snacks in School standards (7 CFR 210.11) and California's stricter competitive food rules (Ed Code 49430–49431.7). In practice, items sold to students from a vending machine must stay within 200 calories, 200 mg sodium, 35% of calories from fat, and 35% sugar by weight — and student beverage machines are limited to water, qualifying milk, and 50%+ juice (8 oz in elementary, 12 oz in middle and high school), with lower-calorie flavored waters and sports drinks allowed in high schools only. California goes further than the federal rule in one important way: no caffeinated drinks for students at any grade level.
The rules apply from midnight until 30 minutes after the final bell in any area students can access. Can we still have a regular snack and soda machine in the teachers’ lounge?
Yes. Federal and California competitive food rules only cover items sold to students in areas accessible to students during the school day. A machine in a staff lounge, front office, or other adults-only area can carry conventional snacks and caffeinated beverages. The key is placement — the same machine in a hallway students can reach would be covered.
What can a vending machine actually sell to students in a California school?
Snacks capped at 200 calories, 200 mg sodium, 35% of calories from fat, and 35% sugar by weight — and each item must be whole grain-rich or have fruit, vegetable, dairy, or protein as its first ingredient. Drinks are limited to water, qualifying milk, and 50%+ juice (8 oz max in elementary, 12 oz in middle and high school), with no-calorie or low-calorie flavored waters and sports drinks added in high schools only.
